AMENDMENT TO THE DECLARATION OF RESTRICTIONS

FOR WADDELL HACIENDAS UNIT I

The Undersigned Owners(s) of Lot(s) of WADDELL HACIENDAS UNIT ONE, a subdivision of Maricopa County, Arizona according to the plat of record in the records of the Maricopa County Arizona Recorder in Book 145 of Maps, page 11 hereby amend the Declaration of Restrictions for WADDELL HACIENDAS UNIT ONE applicable to said property recorded Docket 9172 starting at page 346 in its entirely so that said Declaration will read exactly as the Declaration of Restrictions for WADDELL HACIENDAS UNIT TWO as recorded in Docket 9986 starting at page 25 (as amended and recorded as 98-0294227 dated 4-13-98) of the records of the Maricopa County, Arizona recorder, except for the legal description found at the beginning of said Declaration of Restrictions for WADDELL HACIENDAS UNIT ONE which shall remain unchanged, expect for any reference to Unit Two in said Unit Two Declaration of Restrictions (as amended) which shall continue to read "UNIT ONE" in the amended UNIT ONE Declarations of Restrictions except Paragraph 5 of UNIT ONE Declaration of Restrictions which shall remain unchanged.

This amendment instrument may be executed in counterparts and when executed by the owners owning not less than a majority of the lots within said WADDELL HACIENDAS UNIT ONE, then the President of WADDELL HACIENDAS LANDOWNERS ASSOCIATION, INC. is hereby directed to execute and duty acknowledge a Certificate of Amendment containing the amendment instruments and certifying the adoption of this amendment and the recording of said Certificate shall constitute a valid effective and legally binding instrument to said Declaration.

CERTIFICATE OF AMENDMENT TO THE DECLARATION OF RESTRICTIONS

FOR WADDELL HACIENDAS UNIT ONE

The Undersigned President of WADDELL HACIENDAS LANDOWNERS ASSOCIATION, INC., an Arizona non-profit corporation having jurisdiction over the real estate described in the plat of record in the records of the Maricopa County, Arizona Recorder in Book 145 of Maps, page 11, pursuant to the Declaration of Restrictions for WADDELL HACIENDAS UNIT ONE recorded at Docket 9172 starting at page 346 of the records of the Maricopa County, Arizona Recorder (hereinafter referred to as "Declaration") hereby certifies that amendment instruments have been duly signed by owners of more than a majority of the lots within said WADDELL HACIENDAS UNIT ONE amending said Declaration as indicated in the amendment instruments which are attached hereto and by reference incorporated herein. 

Therefore, pursuant to the authorization granted the undersigned President in said amendment instruments, the undersigned President herby certifies the adoption of these amendments as described in the attached amendment instruments effective upon recording of this certificate.


AMENDMENT I TO WADDELL HACIENDAS, UNIT 2 DECLARATION OF RESTRICTIONS

Article 7 is amended as follows: Further no mobile home, manufactured home or other home similar design will be permitted in Waddell Haciendas UNIT 2, as a permanent structure. All home must be built on site and reviewed by the Waddell Haciendas Building and Development Committee prior to start of construction.


AMENDMENT II TO WADDELL HACIENDAS UNIT 2 DEEDS OF RESTRICTIONS

Membership in Waddell Haciendas Landowners Association: Any owner by virtue of his/her purchase in Waddell Haciendas Unit 2, automatically becomes a member of Waddell Haciendas Landowners Association subject to all its By-Laws, rules, regulations and dues.
